General provisions
The rented goods are the property of individuals, therefore, the Backstage Agency acts as an agent on behalf of owners.
This document constitutes the information of the parties prior to a rental commitment.
The person making the reservation takes responsibility for all the people who will be staying with them, including payment.
Forming the contract
Reservations for accommodation and services are firm upon payment of a deposit of 25% of the total rental price. Any deposit payment implies acceptance of the general rental conditions, of which the tenant acknowledges having read. The contract is established on the day of confirmation of the reservation, sent by e-mail upon receipt of the deposit.
The deposit is payable immediately for any reservation made on the Backstage Agency website www.agence-backstage.com or within 7 days for reservations made by telephone with the Backstage Agency.
The contract does not apply to services provided by external service providers, such as ski rental or lessons, bicycle rental or packages.
Payment of the balance
The customer must pay the Backstage Agency the balance of his reservation of 75% no later than 60 days before the start of his stay. Any payment not made on time will result in the cancellation of the reservation, the agency reserving the right to put the rental week back on the market without prior notification.
In addition to the rental price, the tenant agrees to pay the municipal tourist tax at the same time as the balance of his reservation.
Late booking
If the rental request is made less than 60 days before the start of the stay, full payment is requested at the time of booking.
Conditions of cancellation by the customer
Any request for cancellation must be notified in writing (postal or electronic mail) to the Backstage Agency, the date of sending the letter being taken as proof. The rules that apply in the event of cancellation are as follows:
• the deposit remains acquired once paid
• the balance remains acquired in the event of cancellation 2 months before the arrival of the tenant.
The agency will deduct 3% from the amount of refunds to cover the bank charges incurred.
The agency is in no way responsible for the transport of its clients. It cannot be held responsible for their inability to reach the resort, for whatever reason, and will not make any refunds for this reason.
Cancellation conditions due to the agency
If for any reason, the agency should cancel the customer's reservation, all sums paid by the customer on the date of cancellation will be refunded in full. This is the agency's limit of liability to the client.
Arrival and departure
Entry into the rented accommodation is from 4 p.m. on the day of the client's arrival. The procedure for collecting the keys to the accommodation will be indicated to the client before his arrival.
The customer must leave the premises before 10 a.m. on the day of departure.
Description of accommodation
Although particular care is taken to provide a precise description for each accommodation offered for rent, certain modifications may be made at any time (arrangement or change of furniture, replacement of appliances, etc.) and may not appear in real time. on the photographs and descriptions of the said accommodations. The customer accepts that such discrepancies will not result in any refund.
The photographs and descriptions of the accommodations are not contractual.
Inventory
An entry inventory document is sent to the tenant on the day his rental begins. The tenant has the possibility of communicating any remark relating to the initial inventory of fixtures (inventory of the premises, furniture, equipment, materials and objects furnishing the premises, etc.) to the Backstage Agency by email to the address info@agence- backstage.com within a maximum of 24 hours following the handing over of the keys or entry into the accommodation. Beyond this period, the entry inventory is considered validated by the tenant and any observation will be considered null and void.
The tenant is required to enjoy the rented property as a good father. He must report any malfunction that he has identified in the accommodation during his stay and any deterioration for which he is responsible.
An exit inventory will be carried out by the Backstage Agency once the premises have been vacated.
Security deposit
A security deposit, the amount of which is communicated to the tenant at the time of booking, will be requested on the day of arrival by credit card. This amount will not be debited and returned in full one week after the departure of the tenant if the exit inventory is identical to the entry inventory.
In the event of damage and deterioration to the property, the cost of repairing the accommodation, replacing any missing or damaged objects and/or the necessary extraordinary cleaning, will be deducted from the said deposit. The Backstage Agency reserves the right to keep the deposit for 1 month after its issue if necessary (article 22 of the law of July 6, 1989).
The customer will be held responsible for any damage (other than normal wear and tear) occurring during the occupation of the accommodation by the latter. This liability applies to material loss and damage, as well as any immaterial damage, including but not limited to loss of rental. The tenant's liability is not limited to the amount of the security deposit.
The agency reserves the right to take any additional measure at its disposal against the client, whether to initiate proceedings or to file an appeal.
Insurance
The tenant is required to insure the accommodation he has rented for the duration of his stay, it is therefore mandatory to take out so-called "resort" insurance including coverage of his rental civil liability if his liability is engaged in the event of fire, explosion, water damage and its civil liability "entrusted movable property". He must therefore check whether he is the holder of a contract including a resort extension in order to cover the risks described above, and if this is not the case, take out this insurance.
The accommodation is provided by the owner as "rental owner" without this being able to exempt the tenants from their obligation to take out insurance as defined above.
The agency is insured for its professional civil liability.
It declines all responsibility in the event of theft, burglary and risks incurred for the personal effects of the tenants in the event of a claim. The tenant's insurer cannot exercise any recourse against the owner or his agent in the event of a claim.
Housing occupancy
The tenant will occupy the premises personally and as a good father. He may not lend or sublet the premises to third parties, even free of charge. No commercial or professional activity may be carried out on the premises without the prior written consent of the agency.
The tenant undertakes to respect the internal or co-ownership regulations.
All accommodation managed by the Backstage Agency is non-smoking and pets are not allowed.
Accommodation capacity
The contract is established for a maximum accommodation capacity. For reasons of comfort and security, the customer is prohibited from exceeding the contractual accommodation capacity. Otherwise, the agency may refuse these additional people. The contract will be considered broken by the customer and any sum paid will remain acquired as compensation. The customer will personally assume any harmful consequences of a breach of this obligation.
The price is established according to the accommodation capacity. If the number of participants is lower than the contractual capacity, the overall price remains the same.
Interruption of operation
Interruptions of operation in general services (in particular electricity, heating, hot and cold water, internet access) and public services (snow removal, water, electricity, etc.) cannot justify a reduction rent if they are not due to an act of will of the lessor or the agent of the lessor owner.
The Backstage agency declines all responsibility for deprivations and reductions of enjoyment not resulting from its fault; the same applies in the event of delay by any company in carrying out repair work on the premises.
The tenant will be required to allow work to be carried out in the rented premises, the urgency and necessity of which would appear during the rental, without being able to claim any compensation.
Interruption of stay
Premature departure by the customer cannot give rise to any reimbursement from the Backstage Agency.
Retention in premises
The contract ceases automatically at the end of the fixed term, without the need to give notice.
The rental cannot be extended without the prior written consent of the agency. Any occupancy beyond the dates and times stipulated in the contract would expose the tenant at fault to prosecution for illegal occupancy and a claim for damages both from the agency and from the aggrieved tenant.
Transfer of the contract by the customer
The customer can assign his contract to an assignee who fulfills the same conditions as him to perform the service. In this case, the client is required to inform the Backstage Agency of its decision by email with acknowledgment of receipt, no later than seven days before the start of the service. The transfer of the contract must be made at cost price. The assignor and the assignee are jointly and severally liable vis-à-vis the agency for the payment of the balance of the price, as well as any additional costs occasioned by this assignment.
Election of domicile
The parties elect domicile at the Backstage agency - 74260 Les Gets. In the event of a dispute, the court on which the agency depends is recognized as having sole jurisdiction.
